The Hungarian state, or the local government where either the property manager or the protected building is located, has pre-emption rights for all protected historic buildings, if the decree declaring the protected status, or a modification thereof, so declares. Therefore, one has to calculate with the existence pre-emption rights in every case, which have to be examined separately in every case.
Further things worth knowing are that a historic protected building cannot be demolished in its entirety, and furthermore that the approval of the National Office of Cultural Heritage is required in order to turn a protected historic building into an apartment block, as well as to establish utilisation rights for a protected historic building. In addition, the approval of the National Office of Cultural Heritage has to be secured in order to change the function or the method of use of a protected historic building, to carry out works related to the protected historic building's appearance and characteristics, and for the placement of advertisements. The protected historic building has to be used and utilised in a way that rules out any danger to its protected values.
